Q: Can a person win a case without evidence? I had evidence and loss?
The contractor had no evidence, was not the person that did the work. I had all the evidence and a witness. The case was dismissed in his favor why?
A: There can be many reasons why a case could be dismissed. If the dismissal was a pre-answer motion, it could be due to jurisdictional reasons, improper service, lack of standing, or the facts outlined in the complaint do not support a viable cause of action. If you are claiming that the contractor was not the person who did the work, it makes me wonder if the contractor was the proper party to sue. A more detailed analysis of the facts and circumstances is needed.
A: Every case can be fact specific. Although you presented evidence, cases are sometimes dismissed on technical issues found within civil procedure rules, or they can be dismissed on substantive law issues. It's difficult to tell why your case was dismissed, based on the brief facts of the post. One option could be to review the paperwork with an attorney to examine the grounds for dismissal and manner of dismissal. Good luck
