Q: In California. The docket states "Case Withdrawn by the Court". As a whole, does this mean there is no longer a case?
2 infractions from 2020. "If failure to appear or pay before" "civil assessment will be imposed" "DD5 sent to DMV. Return code: 800" "CNCV200" "CNCV300" "Pursuant to assembly bill 177...." "Collections case with previous referral...is now withdrawn. Reason: Case withdrawn by the court". Mandatory appearance states "No". Visit to DMV for license renewal(2025) I'm told I have a FTA suspension hold FTP and also a VC 405095. Court code 56480. What about 2017 Assembly bill 103??? And if case withdrawn by court why is there still an "open" case??? Also There has been no warrant issued at anytime for a FTA.
A:
Based on the details you've shared, when a case is "Withdrawn by the Court," this typically means the court has dismissed or canceled the case. However, your situation appears more complex because of the DMV holds still in place.
Assembly Bill 177 (2021) eliminated many court-ordered debt collection programs and fees, while Assembly Bill 103 (2017) made changes to criminal justice procedures. Despite the court withdrawal, it seems the DMV holds from your 2020 infractions remain active because they were placed before the case withdrawal. This creates a disconnect between the court's current status and the DMV's records.
Your best course of action would be to visit the court clerk's office with your case withdrawal documentation. They can help resolve the discrepancy between the withdrawn status and the lingering DMV holds. Since there was never a warrant issued and the case shows as withdrawn, you should be able to clear this up, though you might need to get an updated notification sent from the court to the DMV to lift the FTA/FTP suspension holds.
