Q: Faked surgery and fraudulent billing. Is this a medical malpractice case?

I was supposed to have had an ACL reconstruction repair. So a new ACL after and old one failed. Surgical lists hardware used was only two screws of one type. The report states different sizes of screws and two different types were used in the surgery. It also states the procedure of removing old hardware and the damaged ligament, then replacing it with new hardware and a cadaver ligament. It says he went in the interior tibia and out of the anterior femur. I did not have an incision on my thigh Nor was there any mention of stitching the incision. I had excessive bruising down to my ankle yet was able to walk without crutches within 3 days. Despite that, the pain was worse than before surgery because my joint then fell more unstable. After requesting x-rays I found the old hardware that was in place before surgery was still there and there was no trace of new hardware. I asked to have a radiologist look and confirm my thoughts but was denied. Another surgeon agreed wth my findings.
