Q: if my father had asbestos trust claims going and he subsequently passed away from the cancers, can I file wrongful death
I am beneficiary on his claim he has uncashed therefore unaccepted offer that I'm wondering if instead of indemnity if I can now get for wrongful death cases going or am I done? I know atty wants me to agree t terms my dad had but I don't agree , and now we know the payout on those claims is the ball in my court now, the lawyers need me,not my dad to accept terms correct? I get a break down of expenses and fees a week after settlement check comes, so I basically don't trust them to not pencil whip in their expenses , and leaving expenses in the amount they figure their fee on is wrong they charge for recovery percent , of gross settlement, but I get the net? from previous claims I'm only guessing but they will take 5555 as expenses on top of 33 1/3% of the gross on the 50k offer. sending explanation of distribution of funds after sending checks to people who most desperately need funds depositing before reading how fees figured traps them into being at the mercy of billing dept help
