FACILITY INFORMS YOU THAT CPS IS THE ONE THAT NEEDS TO FILE FORM AND EMAIL IT TO THEM. AND THAT CPS LADY KNOWS THAT HER HAVING INDIVIDUAL CALL IS NOT HOW THEY DO THINGS. THEN WHEN CALLING CPS TO INFORM HER OF WHAT I WAS TOLD. SHE TELLS ME THAT SHE SPOKE WITH "LADY A" SHE SAID FOR ME TO SAY IM VOLUNTEERING MYSELF AND NOT TO SAY ANYTHING ABOUT CPS SENDING ME. THAT IM DOING THE SCREENING VOLUNTARILY. THAT CPS WAS NOT MONITORING MY TREATMENT ASSESMENT. THEN WHEN I GO TO SUBSTANCE ABUSE CLINIC LADY A RIGHT AWAY TELLS ME I NEED TO DO A URINE DRUG TEST AND SHE NEEDED TO SEND IT TO CPS LADY MY RESULTS AND THAT I WAS THERE. AND I INFORMED HER THAT CPS LADY SAID THAT SHE WAS NOT GOING TO BE MONITORING MY TREATMENT AND ASSESMENT BECAUSE I WAS VOLUNTERING MY SELF AND THAT CPS HAD NOTHING TO DO WITH THAT ASSESMENT. AND LADY A INFORMS ME THAT SHE HAS TO SEND HER THE INFORMATION BECAUSE BY LAW SHE HAD TO. SO IF THATS THE CASE THEN CPS NEEDED TO HAVE FILED FORM LIKE THE OTHER LADY SAID ..?

You absolutely have the right to decline to submit yourself for a voluntary assessment. CPA would then be obliged to file a motion asking for a court-ordered substance abuse assessment and would have to present evidence warranting it. You would have the opportunity to argue against it and to present evidence of your own.
It is perfectly legal for CPS to ask that you voluntarily submit yourself for a substance abuse assessment. Your voluntary cooperation with such a request would likely be viewed favorably by CPS.
