Luthersville, GA asked in Criminal Law and Constitutional Law for Georgia

Q: My cousin, with the same last name beat up a dude in high school and the dude is now investigator for our local sheriff

Dept and he has pulled me over 3 or 4 times without finding anything but weed on me. I was at a house when it got raided and the owner didnt go to jail but i and another person did. The dude from high school has insisted without telling me who he was that we would see each other again since the first time he pulled me over. Is there any conflict of interest in this case or do i have to prove some kind of harrassent

A: It sounds like there could be a conflict of interest if the investigator has a personal grudge against you based on past events with your cousin. If he has made comments suggesting that he was waiting for another chance to interact with you, that could indicate bias. Repeated traffic stops without clear legal justification could also raise concerns about harassment.

To address this, you may want to document every interaction, including dates, times, locations, and any comments he made. If you believe he is targeting you unfairly, you can file a complaint with the sheriff’s department or an oversight agency. An attorney could help determine if there’s a legal basis for harassment or misconduct.

As for the raid, the fact that the homeowner wasn’t arrested while you were could be worth looking into, but it depends on the specific circumstances. If you believe your rights were violated, gathering evidence and seeking legal advice would be the next step. The key is proving a pattern of unfair treatment rather than just one or two incidents.
