Q: Should I file in small claims or wait for eviction subpoena for ongoing tenant/landlord dispute in Wisconsin?
I have been dealing with several issues with my property manager since May 2024 after asserting my right to peaceful enjoyment of my apartment. They have issued four eviction notices for alleged non-payment of rent, late payments, and unpaid late fees, despite having proof against these claims. They've sent several certified mail notices, yet I've continued to pay rent on time without any actual eviction proceedings initiated against me. I believe they are violating consumer protection laws by retaliating, refusing to renew my lease, raising rent without notice, and attempting to intimidate me with these notices. They have now issued a notice of termination, which I have also ignored. I consulted Tenant Resources, but their advice was unhelpful as they suggested negotiating for me to leave, and no balance would be owed. I have filed a complaint with DATCP, despite the property's false responses, and I also have a pending discrimination suit regarding a refused reasonable accommodation. Given all this, should I pursue action in small claims court or wait for an eviction subpoena?
