I'm seeking to file a federal writ of habeas corpus due to unlawful imprisonment. The defendant was initially arrested on multiple charges, including possession with intent to distribute, DUI, and some misdemeanor traffic charges. A $5,000 cash bond was paid, and the defendant was released but required to participate in a monitoring program. The defendant failed to participate in this program and was subsequently detained as a flight risk after missing a court date. We believe this monitoring requirement after paying bond is an unlawful form of constraint, and need legal advice on challenging this detention.
