Princeton, WV asked in Personal Injury, Consumer Law and Insurance Defense for West Virginia

Q: Is my son entitled to compensation for distress after a bus incident in WV?

My autistic son was on a school bus that encountered a minor rock slide. While there were no injuries or damage to the bus, I had him taken to the hospital via ambulance where he was seen by a doctor. I obtained the accident report for $20. Although he appears better now, he experiences emotional distress if a car behaves unexpectedly or if we discuss the incident. Due to his autism, processing emotions is challenging for him. Is he entitled to compensation for his medical visit and the emotional distress, even if temporary, from the bus company's insurance?
