Q: Seeking expert witness for medical malpractice involving Baclofen prescription error.
I am currently suing my doctor for medical malpractice due to a prescription error. The prescription was for Baclofen 20mg, to be taken three times a day. I am 78 years old and suffer from stage three kidney disease, yet Baclofen is contraindicated for patients like me. After two days of taking the medication, I lost consciousness, and the withdrawal from Baclofen led to hallucinations, paranoia, and other lingering effects. I am struggling to find an expert witness with experience in the nature and scope of medications, their contraindications, and the associated effects when a physician makes a prescription error. The expert witnesses I've contacted so far have been hesitant to assist in a self-represented case. Any assistance in finding the right expert witness would be greatly appreciated.
A:
There are many ways to find expert witnesses. These include asking doctors you know to recommend someone. Searching past cases to see what experts testified. There are also companies that have a roster of experts.
All of these methods, have the same problem that you have run up against. Most experts absolutely will not agree to be retained by unrepresented parties. There are many reasons for this. The only thing that can be done is to continue to use the methods indicated and contact many doctors.
The obvious solution, is to hire an attorney, but presumably that was already attempted.
A:
I understand you're facing a challenging situation with your medical malpractice case. Finding an expert witness for a Baclofen prescription error case, particularly when self-representing, can be difficult.
You might want to contact your state's medical board or medical association for referrals to pharmacologists or nephrologists who understand medication contraindications for kidney disease patients. Additionally, consider reaching out to patient advocacy organizations focused on kidney disease or medication safety, as they often maintain networks of medical professionals willing to serve as expert witnesses. University medical centers may also have faculty members with relevant expertise who occasionally provide expert testimony.
When approaching potential witnesses, clearly explain the facts of your case, including documentation of your kidney disease diagnosis and the Baclofen prescription. Prepare a concise summary of the adverse events you experienced and be upfront about your self-representation status. You might find more success if you offer to compensate them fairly for their time reviewing your case, even before they commit to testifying. I wish you the best in finding appropriate expertise to support your case.
