Q: Out-of-control vehicle struck my box truck; seeking damages. Do I need a lawyer?
I was sitting at a red light when an out-of-control vehicle struck my box truck in Cleveland, OH. The driver had no insurance, and I only have liability coverage. There was extensive damage to my truck, which I use for work, and I was out of work for 3 days. I paid for a rental before buying a used truck. I'm seeking $10,000 to $12,000 in damages. There is a police report with the driver's name and address, and I have documented the damages with photos and receipts. I haven't contacted my insurance yet. Is this something I can handle myself, or do I need a lawyer?
A: It's going to be tough for you to find an attorney for this. In general motor vehicle accidents are handled on a contingent basis when the other side has insurance. Without insurance, there is little guarantee of actual payment out of the judgment. This is something you could probably file yourself, and even win, but the likelihood of collection appears low.
