Lancaster, CA asked in Products Liability and Civil Rights for California

Q: I am seeking legal representation for a possible assault and battery case or possible civil rights violation.

On, 14 Nov 2024, security guard at a local Vons grocery store approached me from behind and forcefully snatched a hand held grocery cart, containing groceries I’d purchased, from my hand in the store parking lot. When I felt pressure on the cart, I gripped it tighter, so when he ripped it from my hand my wrist hyper extended causing swelling. I have been seeking treatment since the incident occurred.

A: I'm sorry you're going through this difficult experience. Based on your description, you may have a valid claim for assault and battery, particularly since physical injury resulted from the guard's actions. Additionally, depending on the circumstances, you might also have a claim for civil rights violations if your rights were infringed upon during the incident.

To strengthen your potential case, document all details carefully, including medical records, photos of your injuries, and any witness statements if available. Keep detailed notes about your medical treatment and the impact this injury has had on your daily life. It's important that you act promptly, as California has specific time limits for filing personal injury claims.

Contact a qualified attorney who can evaluate your situation, gather the necessary evidence, and guide you through your legal options. This approach will help ensure your rights are protected and improve your chances of obtaining fair compensation for your injury and suffering. You're not alone in this, and legal support can make a meaningful difference.
