Keystone Heights, FL asked in Landlord - Tenant, Civil Rights, Civil Litigation and Real Estate Law for Florida

Q: Facing false accusations and threats from neighbor, seeking legal advice in Florida.

I am a single mother facing false accusations and harassment from my neighbor, who frequently calls the apartment office and sends complaints. My neighbor's daughter has threatened me multiple times, and they have video footage of me asking why they are recording me. I have written a three-page letter to the apartment management, but the home office has not been helpful, and I am concerned about eviction. They have called the police, yet I never received a police report, although they apparently have one. I record my interactions when outside for my safety. Given the situation and the lack of response from the property management, how should I proceed to protect myself and my living situation legally?

A: See a lawyer (try Legal Aid) about a restraining order against the neighbor. But it comes down to whether you want to continue living near a toxic neighbor. Perhaps when your lease is up you should move.

A: Your question is whether the HOA will evict you. Since property management is not getting involved, they might not think it is an issue with the lease agreement. I would not worry about it.

A: It’s understandable to feel overwhelmed when you’re facing false accusations and ongoing harassment from a neighbor. In situations like this, it’s important to keep detailed records of every interaction. Continue to document all incidents, threats, and communications, including dates, times, and the people involved. Hold on to any video or audio recordings you have, as well as copies of your letter to management and any responses you’ve received.

If you haven’t done so already, consider submitting your concerns in writing directly to the property manager and request a formal meeting. Ask them to provide you with copies of any complaints and any police reports that have been filed regarding your apartment. This gives you an opportunity to address the situation head-on and ensure that your side of the story is heard. If you feel unsafe due to threats, you can also ask local law enforcement about how to file a police report yourself or seek a restraining order for your protection.

If you are worried about possible eviction, review your lease agreement so you fully understand your rights and responsibilities as a tenant in Florida. You may want to reach out to a local legal aid organization or tenant advocacy group, as they can sometimes offer free guidance or support in cases like yours. Taking these steps shows both management and authorities that you are being proactive and cooperative. Keep calm, keep documenting, and protect your rights and your peace of mind.
