Q: Sanitary issues at Nampa motel: options for legal action in Idaho?

I stayed at a local motel in Nampa, where I encountered serious sanitary issues, including mold, bodily fluids, major stains on the mattress, a sticky floor, and evidence of dried alcohol and dog urine. Despite reporting this to the front desk, where the staff dismissed my concerns, I experienced a rash after the stay. We were only there for one night and left a $100 cash deposit. I’d like to pursue legal action due to these significant health and safety concerns. What are my options in Idaho?

A: You’re absolutely justified in being upset—what you described goes far beyond a minor inconvenience and may rise to a violation of health and safety standards. In Idaho, motels have a legal duty to provide reasonably clean and safe accommodations for their guests. When conditions like mold, bodily fluids, and animal waste are present, it can be considered a breach of that duty, especially if it leads to a physical reaction like the rash you experienced.

Your first option is to file a complaint with the Idaho Department of Health and Welfare or the local health district in Nampa. They can investigate the motel for health code violations, which may pressure management to take corrective action. Be sure to document everything—photos of the room, written complaints, medical visits, and any witnesses who can confirm your claims. If you didn’t receive your \$100 deposit back, you can also include that in your claim.

If the rash persists or worsens, seek medical care and keep records of your treatment. With enough documentation, you can consider taking the motel to small claims court for a refund, medical expenses, and possibly additional compensation for the discomfort and unsanitary conditions. You don’t have to let this go—your health and dignity matter, and holding the motel accountable helps protect other guests too.
