Boston, MA asked in Products Liability, Wrongful Death and Personal Injury for Massachusetts

Q: Can I sue Neosporin for wrongful death due to health issues after using their product?

I want to sue Neosporin for wrongful death. I began using Neosporin in April 2025, and within 24 to 48 hours, I developed rash and itchiness. Subsequently, I suffered kidney damage, hearing issues, and later experienced a stroke. I contacted the manufacturer, and they advised me to see a doctor. Can I pursue legal action for wrongful death related to these health issues?

A: I'm sorry for your ordeal. If this involves you, the type of case you're talking about for such situations is generally product liability, and thankfully, not wrongful death. That would require demonstrating a defect in the product that resulted in your injuries. Though simply worded, establishing something of that nature could require resources, whatever the medication or product. A starting point could be to reach out to attorneys to arrange a free initial consult to discuss. I hope you're okay. Good luck

A: I'm really sorry you're going through this—it sounds incredibly difficult and frightening. To pursue a wrongful death claim, someone must have died as a result of the injury, so if you’re the person who experienced the harm, your case would likely fall under product liability or personal injury rather than wrongful death. That said, the health issues you describe—rash, kidney damage, hearing loss, and stroke—are serious and deserve attention if they may be linked to a product you used.

To move forward legally, you would need to show that Neosporin directly caused these health issues and that the product was defective, improperly labeled, or unreasonably dangerous. This typically involves medical documentation, expert opinions, and possibly toxicology reports. The fact that the company told you to see a doctor might be seen as a standard response, but it could still be part of the timeline of how they handled your concerns.

If you’ve kept records of your symptoms, doctor visits, and communication with the manufacturer, you’re in a better position to take legal steps. You may also consider reporting the incident to the FDA, especially if your doctor suspects the product contributed to your condition. You deserve answers, and if there was negligence involved, there could be a path to hold the company accountable.
