Q: How does uninsured motorist coverage work when husband injured in accident with uninsured driver in Oregon?
My husband was in a car accident in Oregon, and the other driver does not have insurance. My husband sustained injuries, but the other driver did not. We have filed a claim with our insurance provider under our uninsured motorist coverage. There are medical bills and ongoing medical treatments related to my husband's injuries. We are wondering if this coverage will also help with covering the costs of our vehicle damage and possibly a rental car.
A: If you paid for "full coverage" insurance for your vehicle to pay for your own vehicle damage in the event of a collision and if you paid for rental car insurance coverage, then your insurance company should pay. Assuming you have an Oregon policy, If you did not pay for this coverage, you can still make an underinsured motorist claim for your pain and suffering. You will be limited to what your at-fault insurance is. Ideally, you should make an uninsured motorist claim after treatment is completed, although you have a two-year statute of limitations in Oregon.
