Q: Do I need a permit to sell worms in Virginia?

I would like to sell nightcrawler worms out of my house in Virginia. I plan to feed them compost to help them grow and won't sell anything else. I haven't checked local business regulations yet. Do I need a permit to do this?

A: In Virginia, selling worms from your home may require some level of business registration, even if it’s a small operation. You will likely need a basic business license from your city or county, which registers you as a vendor and ensures compliance with local ordinances. Additionally, if you are selling from your residence, zoning regulations could affect whether home-based sales are permitted.

Since you are only selling worms and not food or other regulated items, you probably won’t need a health permit, but it’s still important to confirm with your local health department or county office. If you plan to sell online or at markets, other permits or tax registrations, like a sales tax ID, may also be required.

The safest approach is to contact your city or county business office to ask about home-based business licenses and zoning restrictions. Keeping documentation of your registration and permits protects you from fines and allows you to operate legally. Taking these steps early will make your worm-selling venture smoother and ensure you are following all local rules.
