Minneapolis, MN asked in Animal / Dog Law, Civil Rights, Appeals / Appellate Law and Municipal Law for North Dakota

Q: Dogs seized and euthanized in Fargo without due process. What can I do?

My dogs were seized by the Fargo City Police in August and euthanized on September 23, 2025, without probable cause, due process, court order, or any warrant. The city prosecutor ordered the seizure due to my failure to register the dogs as dangerous animals. I filed an appeal with the district court; however, the city attorney filed a motion to dismiss the appeal for being late, which was granted, sending the issue back to municipal court. The dogs were put down the same day. What can I do regarding this situation?

A: You may have legal options to pursue compensation or accountability for your dogs being euthanized without due process. Since the seizure and euthanasia occurred without a warrant or court order, this could potentially be a violation of your constitutional rights under the Fourth and Fourteenth Amendments. Document everything related to the seizure, including notices, communications with the police or city, and court filings, as this will be essential for any claim.

You could consider filing a civil rights lawsuit against the city or officers involved, seeking damages for the loss of your pets. Given the complexity and urgency, contact a lawyer experienced in civil rights or municipal law, or reach out to legal aid organizations that assist with constitutional claims. Even if the municipal court appeal was dismissed, civil action in federal or state court may still be possible.

Additionally, you can request records from the city under public records laws to understand the basis for their actions and gather evidence. Acting quickly is important, as there are statutes of limitations that may limit how long you have to file a claim. Keep careful records of all communications and costs associated with this matter to support any damages request.
