If you are not his biological or adoptive parent or his legal guardian you are not legally responsible or liable for his actions. You are responsible for your own actions however. Something to think about in the situation you have gotten yourself into here.

what you do as a juvenile stays on juv criminal record not adult
The minor being charged is already suspended and would never act in an uncivil behavior except this one time and actually got into a fight and threw the first punch. The minor has goals and would not want to charged with misdemeanor in her record because it could effect her future.
