Minors are considered legally incompetent for some purposes when it comes to Signing a contract. Other contracts they can be held to. And example would be when you agreed to pay two dollars for a candy bar and then eat it
“victim” had consensual intercourse with “offender” of a 2 year age difference. Since the age of consent in california is 18, this is considered statutory rape. Parents have talked about filing charges but have not, the “victim” will be 18 in 4 months. Can the parents press charges... View More

You're operating under a misconception that the parents have the ability to press charges and/or that this matter is within their "jurisdiction". Only the District Attorney's office has the power and jurisdiction to file and pursue criminal charges.
With that being... View More

No. It is illegal to secretly record a private conversation where one of the parties has a reasonable expectation of privacy. California's wiretapping law is a "two-party consent" law. California makes it a crime to record or eavesdrop on any confidential communication, including a... View More

normally not retroactive......but if new law is helpful your lawyer should argue it should be applied and you should not be punished because of the time of the sentence.
maybe put on calendar for Reconsideration of sentence in light of new law
He wrote me down for 98 on the ticket as well but it’s my first ticket ever. What’s the longest I could get my license taken away for.

if the injuries are severe enough the DA could ask for a minor to be prosecuted as an adult.

Sex with a minor under the age of 18 years old is statutory rape. A minor cannot consent to having sex. The pregnancy is evidence of the rape. The young man responsible can be arrested and prosecuted for statutory rape.

what you do as a juvenile stays on juv criminal record not adult
The minor being charged is already suspended and would never act in an uncivil behavior except this one time and actually got into a fight and threw the first punch. The minor has goals and would not want to charged with misdemeanor in her record because it could effect her future.

The minor is too young to consent. The parent can get restraining orders against a man, and if there is suspicion that sexual activity is taking place, then a report can be made and the minor can be taken to a medical facility for a medical exam to determine if there, in fact, has been sexual...
