Yes, she could. But it is also likely you will be awarded the sole power to make healthcare decisions for your child.

Only the child you have with this person can be considered for actual custody but the circumstances surrounding the other children may also be considered in determining the award of custody of the child in question.

The facts as you set them out do not support a change of venue. There is a backlog of cases already in the jurisdiction you mentioned still waiting for adjudication. It takes a while to get a decision.

Yes. She can take you to court if she is the mother of the children. Yes. It is legal. If her request is denied or determined frivolous, you could be awarded your attorney fees insured.

You need to hire an attorney, file a motion to modify residential custody and attach a report from his therapist (or get him in to see a therapist if he doesn’t have one.

Depends on how title to the property is held; whether daughter has contributed any money to the house over the 20 years. She most likely has a claim of some degree that can keep her there. She needs to talk to a lawyer immediately.

You can probably regain visitation but one would have to review the file and the rulings that are in place. Additionally, the case may have to be litigated going forward in New Mexico under the UCCJA.

She can go apply for an epo again him. It is up to the Court whether they allow it or deem it retaliatory.

Since they have custody currently, they have the same standing as you. Probably should only seek joint custody bc the standard for sole custody is much higher.

If your child is in an unsafe or dangerous living environment, report those concerns to CPS. Obtain a lawyer. File a motion in circuit family asking for change in parenting time and/or suspension of time for custodial parent if dangerous conditions.
