Q: If there are five lanes with the middle being a turn lane the is this a divided highway

School bus is stopped in far right and I am in the far left, do I have to stop?

Yes, you have to stop. A divided highway is a road with an intervening space, barrier, or a clearly indicated dividing section constructed to impede vehicular traffic. A middle turn lane is not an intervening space.

If there is a bench warrant, you should retain an attorney to represent you. An attorney can file a motion to recall the warrant. “Ticket” and “citation” are the same thing: interchangeable terms. They are the charging document for the traffic violation. Speeding is a minor non-jailable moving violation. Q: i received a ticket for driving passed a stopped school bus allegedly. I tried to request a court date but i was told

I was told that i waiting to look and can no longer receive a court date. But it say no where on the ticket the due date of requesting a court date.

Can i still get a court date to fight this ?

Is it true that a date should be on the ticket of how long i have to request a court date ?

The Maryland Uniform Citation form has an inset box on the lower right portion of the ticket that contains instructions on how to pay, plead to the ticket, and how to request a tial date, and it states the timeframe (30 days) you have to do it in. I was told a law was passed that if incarcerated you don't have to retake everything

I am not aware of this law, but it does not mean that it does not exist. Your best bet is to contact the Motor Vehicle Administration and ask.

Q: Does Title 21-706 apply to 5-lane highway that includes two lanes on each direction of traffic, plus a turning lane?

I received a citation for going in the opposite direction of a school bus stopped on the opposite end of the 5-lane highway (the highway is not divided, but has a center lane for turning vehicles).

Yes, the statute applies under these facts. It would not apply if there was a median dividing the highway.

We’re these fines imposed by a judge after you requested a trial date and appeared for trial? If so, and if 90 days or less has passed since the trial date, you can file a motion with the court for reconsideration and reduction of the fines

It is a minor moving violation, and although I do not know NC penalties for this offense, in Maryland that would be a 1 point infraction, so a very minor non-significant impact on your driving record and no effect on your driving privileges. You do not state what the citation was for—how serious it is, or what the potential consequences will be if you simply pay it. Driving with expired tags: $500. Displaying and driving with tampered/altered tags, or with fraudulent intent: two months and/or $500. The length of time you drive with them does not change the possible penalty.

If it was a camera ticket, it only carries a fine and does not carry points. They will give you a link to a video of the incident. If you already passed the bus when the red lights flashed and the stop sign extended, then you should win at trial. Of course, it is up to the judge to decide the case.... View More

Q: Hello I have a citation, and I was wondering if I am traveling on a main roadway and there is a soild yellow line

Indicates no turning / crossing the line from my side do I have to stop on a school bus sign/signal due to it just being for the opposite side of traffic in this case would those lines not act as a median of sorts for traffic ?

Yes, you must stop for a school bus. The law says you do not have to stop if there is a median. A double yellow line is not the same. Take a look at the statute.
