Q: Hi, I got a failed to obey traffic device ticket (section 3111) does that carry any points?

If you have a Pennsylvania license, a conviction for 3111(a) will not give you any points. If you have a license from another state, including a CDL from another state, that answer may change and you should consult an attorney.

Q: A cop pulled me over and told me he would mail me a citation, but never asked me to sign anything.

I’m not sure if this is something I’ve experienced but I was always made to sign something when getting a ticket. (I got one 2 years ago in NJ) Not sure if I will actually be getting a citation or if it was a scare tactic?

You should absolutely plead not guilty. At the very least, it may be possible to have the citation amended to a section that will not add points to your license. Consult a traffic attorney in your area for more information.

Yes it is permissible for the citation to be mailed to you under the circumstances. You should contact an attorney to discuss your options. Many times, we can get the speed reduced on the citation to reduce or eliminate the number of points that are assessed to your license.

Here's your problem. At that speed a judge is going to be upset. Really upset. It is ultimately up to the judge even if the cop wants to help you out. Plead not guilty and get a lawyer. It is the most serious ticket in PA and carries with it 5 points plus an automatic 6 month license suspension. The police do not have to pull someone over to issue a citation if they believe they have the evidence to prove it.

He made the same mistake I did. He saw a 2 and thought 3. I saw a 1 and thought 2. Is this enough to dismiss the ticket? What's the best defense strategy to at least get the fine reduced?

No. If the sticker wasn't expired is a defense. The fact the cop missed a couple of numbers won't get you anywhere. Get the car inspected and maybe they'll drop it. In the meantime, don't drive it around without inspection.
