I advise hiring a competent attorney to represent you. You definitely need to go to Court and act in a respectful manner. Apparently you acted appropriately or the LEO would have arrested you. Your ignorance of the bad light will not work. You might get the light fixed and take the receipt to Court with you. The worst that can happen is you are found guilty, but it might get dismissed.

It is up to the LEO' s discretion whether to arrest you or not. Sometimes you will still report to get booked. But apparently you have to go to Court for Speeding, where your stopped and handled yourself before the officer fairly well. Go to Court and act respectful. The worst that can... View More

Go to Court in a respectful manner. Bring your Registration and Insurance in case the DA /Judge inquires. It might get Dismissed or lowered to a lower MPH over. A lower speed will lower the number of points going against your MVR for the last year, and you are only allowed eleven.

The Sentence will probably be costs and a fine. And points will go against your MVR for the last year. Go to Court in a respectful manner. It would help a little to plead to a less than 20 mph over.

Get a duplicate Registration Sticker and go to Court. Hopefully it will be dismissed.

Yes.. SOL on Misdemeanors is 1 year. You should go to Court and politely explain why you changed lanes.

Get the registration current and go to Court. It might even be dismissed with payment of costs. Do not just mail in a fine and then possibly have a problem with the DOS.

You might consider going to Court and seeing if the DA will allow you to plead to a 25mph over, which might help a little. Points on your last year's MVR is the problem. Q: I got pulled over for going 28 over yesterday. Is there any way I could go to jail?

I do not normally go this fast and I genuinely did not mean to. I looked down and realized so I slowed down. However, by the time I was slowing down, I saw the lights behind me.

Apparently the LEO has already gave you a Citation instead of arresting you and getting a Warrant issued. It is usually at the LEO's discretion, and apparently you acted appropriately when the emergency lights were activated. Be respectful in Court.

In TN the accident report is inadmissible evidence by Statute. So the LEO testifies to what he finds when he goes to the accident scene, and tells what available (in Court) declarants told him there.

Q: I recieved a speeding ticket 90 in a 65. Court was cancelled and rescheduled. I went both times cause I was told too.

I recieved a letter saying I had to be in court on such day, 5 months later. I couldn't make that day and now they say I have to pay ticket which will cancel my insurance.

I am afraid that you did this to yourself. You probably should have hired an attorney to represent you. Now either pay the costs and get the MVR points, or lose your TNDL.

Q: Speeding 45 in a 30 by LEO traveling in opposite direction with cars in front of him- states radar verify. Dismissable?

The court printout of ticket has incorrect address, incorrect DL# and wrong court date. LEO states radar tracked me at 45 in a 30 going there opposite direction. Is there a chance that I can get this dismissed?

Check with Court Clerk about the exact Court Date. Go to Court and be respectful about telling either the Prosecutor or the Judge about the incorrect Citation. Hopefully you will receive a Diversion or a Dismissal.

Absolutely... LEO's can execute a legal stop for any Rule of the Road Violation they witness. Then other Charges may follow.

No. That is only an acknowledgement of the Citation instead of Arrest. You will need to go to Court in a respectful manner. Be polite about the lack of signature.

You probably mean capias warrant. Hire a competent attorney to take you to Court when you are not on the Docket to set aside the capia and resolve everything. Have money ready to pay the costs and fines. Most likely you will walk out of there.

If the Citation was actually dismissed, then no points go to the MVR. But you apparently misunderstood the Judge, or the Clerk is mistaken. Either way you will have to pay those monies now, or it will be reported to DOS and they revoke your TNDL.

I was trying to merge over in a 65 but I wasn’t able to so I sped up to 93 so I wouldn’t have been run off the road. the officer saw some toys on my dash so he wrote the ticket for the due care

Do not understand your facts. But go to Court and act respectful. It might get diverted or reduced. Paying it by mail is a conviction, and you are only allowed 11 points on your MVR for the last year.

Absolutely... It is usually the LEO's discretion whether to arrest someone without a warrant or to issue a citation/summons to Court without arrest. But it is the Charge that is important, not whether you were arrested or not.

A Virginia lawyer would be better suited to help you. You will need to call every Court Clerk in the vicinity of where the speeding violation took place.
