Q: roommate not on lease now in jail owes 5 grand back rent since covid whats my options?

In clearwater, fl. A roommate who was not on lease is now in jail and owes 5 grand back rent since covid started. I have meticulous records and two other roommates as witnesses whats my options? He's currently incarcerated, so I figure now is a good time to try and get some of the money owed back.

You could sue him for it, but most incarcerated people don't have many assets, so he's probably judgment-proof.

Yes, you have an affirmative duty to file any Will with the clerk of the court in the county where the deceased person was a domiciled resident (where their Homestead is located). Q: We bought a home in November 2021. The inspector missed a big problem with our plumbing. Can they be held responsible?

Our sewage lines are held up by boards. I feel like they should have caught and addressed this problem. They have to now be replaced so that we can use our toilet.

You may have a negligence claim. But you'd need to read your agreement with the inspection company as well.

If you could not use your toilet since you moved in, maybe it is a material defect that should have been disclosed by the seller as well.

Depending on the wording of the agreements the two of you signed, he is probably not entitled to anything. But have an attorney review the wording of the agreements, to be sure.

Q: In an uncontested foreclosure can the mortgagor keep the property without selling it?

I am the mortgagor and would like to foreclose on the mortgage and just keep the property. The person on the property is not responding to attempts to resolve the issue and only made one payment. I was hoping to just foreclose and keep the property. I am located in Florida.

No; the court will order that the property be sold. You can bid at the sale and, if there are no higher bids, you will get title to the property.

Q: I have an older property in Airbnb and a guest staying there fell through to the next level when a step gave way

It is not illegal to do so but it defeats the purpose of having two separate LLCs since you'll be commingling funds.

Q: I have learned that last year my father was able to secure a HELOC against the home he has a life estate in.

The lender could foreclose upon the life estate, assuming a default and assuming that you and your sister are the remaindermen (not co-tenants of the life estate). Q: Is it right to arrest a person on a boat with foreigners and bring them into the country and charge him for smuggling?

Q: Bought a home in an HOA and the realtor who was employed by the developer provided false information to entice the sale.

I was told as were many other residents that our homes would be painted every 5 years but it is already 8 years and Property Mgr. says that the HOA does not have to paint as it is not in our docs. Is there any recourse?

Q: I own a rental property in foreclosure in Florida that I deeded to a single member LLC for that property only. I want

You can do the first two but the court is not likely going to remove the LLC from the case because it had an interest in the property at the time of the foreclosure and that interest needs to be foreclosed.
