of me as I was going 35-40 mph. there was no airbag deployment I called Chrysler they sent someone to the shop it was in and said there was no problem I traded the vehicle off after the damage was repaired due to being afraid to put my family in it with no airbags today two years later I received a... If there had been air bag deployment your vehicle may have been totaled anyway--have to add to the damages cost of replacing the airbag(s). Your fear of that didn't make it unusable. Also, if the hit was not dead center or within 7 degrees of top dead center, the airbag may not deploy. So... View More

First, unless you want to kiss your license goodbye, you need to plead not guilty--which also gives you extra time to think; plan on paying for a legal consultation. Most lawyers will work out payment plans. Second, get a hold of the police report. Costs $15, but the lawyer will need to see that.... View More
My friends car accelerated he took out a parking meter and hit a corner of a wall. No one got killed he had a little bump on his head, and he made the mistake of leaving the accident. No one was really hurt but PennDOT wants to keep his license for a year and the reason they give is 3742 a vehicle... View More

Your friend needs to unwind things with the Court. Did his address match the address on his license? If not, all mail went to his license address and that's on him. Second, he goes to the Court of Common Pleas for the County where it happened to find out. He either got a citation at the scene... View More
Motorcycle was parked on the street. The other driver is noted for being at fault. Do I have the right to chose where to have the bike repaired, if their insurance is paying for it?
answered on Aug 22, 2017
Two options. Settle or sue in small claims court.
If you have insurance, and deductible is not too large, they can pay, and then use their lawyers to collect from the at fault party.

Your questions is so clearly worded about this situation that it is clear that you are trying to misrepresent facts, to save money.

YOU AND YOUR INSURER ARE ON THE HOOK
I was in an accident and the other driver's car was totaled, they want me to pay their $1,000 deductible even tho their car was totaled
answered on Aug 12, 2017
The deductible applies even if a car is rendered a total loss. Your own liability insurance should cover this.
Cause they have the wrong model and are off so much. To me it tells me they are looking for a 4 door model car. Even if they messed up the fine. Thats a big mess up.

Sorry, but you need an attorney. You are looking at points, suspension for the 3744, fact that they didn't put the right number of doors on the car etc won't matter if your's was involved in the wreck, you didn't have insurance, and were driving carelessly. You need to contact... View More

Worker's compensation cases are much different than typical personal injury accidents off of the job like a car accident. The ability to collect money beyond the lost wages and bills are usually set by some kind of schedule or cap. Rather than guess at what you may be entitled to, set up a... View More
Neighbor is upset is there any reason for me to worry about it being towed or me being fined?
answered on Jul 7, 2017
Why should the neighbor care? If it's tagged and insured, you should be OK unless 1)you are in a condo development and have violated some HOA rule b) your township requires that vehicles be moved, not parked for a long time. Suggest you move it around--you'd want to to get the fluids... View More
We were involved in a traffic accident 3 weeks ago, my 20 year old daughter was driving. She made a left turn at a traffic light and we were hit in the back end (100% behind the rear wheel) of our vehicle when we were 3/4 of the way into the roadway we were turning into. He hit us in the shoulder... View More

Possible depending on the area. You all may have injury claims and should use the medical to see a doctor if you were hurt. Contact a member of the Pa. Assn for Justice--we give free consults so you can have your case evaluated. If you don't already get a copy of the police report. Don't... View More
I hit a car while backing out of my own parking lot in Philadelphia's narrow st. The car was parked in a non stopping zone right behind of my parking lot. From what I read, it seems that I would be at fault because of backing the car.
answered on Jun 29, 2017
You are correct--moving vehicle doesn't have right to hit a stopped vehicle, even an improperly parked vehicle.
Also she drove the car away from the scene could she have case more damage, she didn't give insurance info to me
answered on Jun 24, 2017
Not sure about your question. You can call me at my toll free number. Generally as long as you exchanged insurance information you should be OK. Report this to your insurance.
I only have liablity and my phone was dead and they kept telling me I can't report it or else I'm held responsiable. It happened a little over a week ago. Is there something I can do? If you sue your boyfriend for your personal injuries and damage to your car, your liability insurance would, at least initially, be primary and provide coverage, and your boyfriend's insurance would be excess and provide additional coverage. However, if your boyfriend was driving without your... View More
The husband hit my car. He wont respond to my insurance company's and I call and letter. Can I sue the wife also. She said there separated and she is trying to serve him divorce papers but we have seen him at the house multiple times.
answered on Jun 5, 2017
As a general proposition, you can assert a claim only against the driver of the car. Under certain circumstances, however, you can also sue the owner--for such things as negligent entrustment or agency. In this instance, if the wife is not a co-owner of the vehicle, you have no basis to sue her.... View More

Yes and Yes.
Not sure why they didn't write it up on the spot, but if you run off the road the implication is you 1)weren't paying attention or 2)fell asleep at the wheel or 3)driving distracted or 4).......driving too fast for conditions (which is what "unsafe speed" is about).
-Copy of accident report given at scene mentions no citation given
-Citation received says driving at unsafe speed. Yet no one observed the speed of the car
-Weather was stated as being snowy. There was no snow that day. Snow on road was blown across from previous storm. Road... View More

1)plan on fighting it--staties don't settle. Look for an attorney who handles cases in that DJ court. Sucks but it's better than points. 2)Reason you got it is likely you crashed on a highway, so presumption is your speed too high--otherwise you wouldn't have crashed.

Clearly the driver is responsible. The matter would have to be reviewed by a lawyer to determine if there is a case against the owner for what is called "negligent entrustment," and/or, if the driver was drinking at an establishment which held a liquor license, if there is a case against...
