Q: Is it possible to bring negligent homicide charges against surgeon who failed to follow procedures in a timely manner?

Surgeon didn't write up surgery notes for 20 days resulting in uninformed post operative care and death within 2o days of surgery.

surgeon failed to follow up on blood tests that indicated severe infections resulting in death.

surgeon failed to review post op notes that would have detected condition.

surgeon misrepresented operational notes indicating senior surgeon was present when operating records show he wasn't.

original post op appointment was postponed for four weeks.

surgeon staff failed to listen to patient repeated calls for post op care and illness.

patient had aspergers syndrome and not accommodation was made to insure he understood risks.

patient died of sepsis and adult respiratory distress 19 days after being released from hospital.

patient is 35 year old single Florida resident so malpractice suit is not an option.

hospital admitted surgeons didn't follow post operative procedures
