Q: My son was inner tubing behind a boat. when they turned he was falling off tube pulled 2 teeth out bone this civil suit

Just wondering if this would be a civil lawsuit? When the driver made a turn his inner tube speed up.causing his tube to go out of control when he came off tub the stiching tore his 2 front teeth out of bone. We cant prove neglegens on driver at the time. But he did not follow laws before or after the accident. just wondering if we would have a case and if so is it a civil case? Insurance company wants to settle for $25,000 but we have $13,000 into it. we want to make sure my son has enough for down the road if he needs to have more work done. is this a fair deal to take the $25,000

A: Sounds like a possible suit to me-the very fact that he had an innertube attached to his boat and was tugging a minor is negligence enough for a suit and even more so depending to an extent on what laws were that he was violating. Without having more information, I cannot tell you whether the offer is fair, but my instincts tell me that this is a low offer. The insurance company knows that you are not represented and is taking advantage of the situation.
