Q: In the state of Indiana, can I find out the status of my divorce online and can I assume all debt and then file Chapt 7?
The divorce is uncontested. The settlement will split some debt in court but I know my ex cannot pay anything. I would like to assume the debt and move on or it will be a painful volitile situation. I am having a protective order issued, as it is and want no further contact of any kind with him. I would like to assume the debt then file Chapt. 7. Most debt was in my name anyway as he had no job and no way to pay most of the 20 years we were married. Also, he was arrested in 2002 for misdemeaner drug charge. Will the judge see this? I would hope so. What information does the judge see?<br/>

I am an IL attorney and am not qualified to answer a question that pertains to IN law, but the answer to your question should be the same in all states. If you assume the debt and then discharge the debt in bankruptcy, your husband will still owe whatever he owed before.
Your agreement to assume all the debt is not binding on the creditors. You are not divorcing them, you are merely divorcing your husband.

A: You may or may not be able to see the status of your divorce online, depending on what county your case is in. A chapter 7 will release you from marital and your own debts only, not him. The judge sees what information you present to him or her subject to the rules of evidence.
