Q: Am i required to testify against my spouse for domestic violence in mn?
My spouse will soon be on trial for domestic violence. In the state of MN, do I have the right to refuse to testify against my spouse in court, even in the case of domestic violence? If not, and if I still refuse testimony, what consequences would follow?
A: You do not have to testify unless you have been served with a subpoena. If you have been served with one and you do not appear to testify then you could be held in contempt of court and civil and or criminal consequences may follow.
