Odessa, FL asked in Social Security for Florida

Q: How long is the statute of limitation for the Zebley law in SSI. Mother and son filed in 1982 for exact same disability

Mother and son were turned down by Social Security. Son was 12 at the time. In 1993.when son was 23,he found out he was eligible for back pay restitution through the Zebely law and received a big check. Mother did not get anything. who has the exact same disability. Both were seen by the same Social Security doctor. For son to receive a check and not the mother for the exact same disability, a life long disability,permanent, is this not an age discrimination?

A: Just because it would appear to be age discrimination, does not mean that it is. There were probably differences between the two cases. Has the mother reapplied? She should get to a social security lawyer immediately, it is a long process which needs to get started.
