Q: Do I Need a slander attorney?

My husband was recently accused of racial discrimination at work. After an investigation, he was cleared of all wrong doing. Now, the guy who made the claim is trying to sue us through civil court. Do we have a case for slander or defamation? We do have documentation that he is making untrue statements directed right at my husband.

A: most importantly, you need to defend the civil case. in that case your lawyer may chose to assert a counterclaim on your husband's behalf against the accuser. there is strategy involved in doing so or not and your lawyer may think it better not to. he/she is in the best position to guide you on this and you should trust the advice. false accusations can be but are not always defamation ( slander is verbal and libel is written defamtion). simply, defamation is something communicated that is untrue that causes damage. sometimes damage is presumed and there are some instances where there is a privilege (protection) or qualified privilege to defame. your lawyer will know all of this. being the victim of a wrongful accusation is a very troubling thing but rest assured that the people that count will judge your husband by the person he is. good luck and god bless the both of you.
