Q: My children were wrongfully taken out of my care, what can I do?
CPS picked my children up from the babysitters due to I was intoxicated and had police contact and they were at a babysitters. NO criminal charges then or prior (EVER, the extent of my criminal backround is a couple speeding tickets years ago). My children were simply with a babysitter as I left them for the night while I went out and conducted in "adult behavior with adults". The police were called to the place I was drinking, I was intoxicated. (that was the plan for the night- exactly why I had childcare for the night). I was NOT arrested or charged with anything, the police took me home. CPS has my children in custody (60 days as of today) using "neglect" as the foundation. My children were at the babysitters taken care of for about 4 hours leading up to them being picked up. There is NO criminal backround, NO neglect or abuse EVER. where do I turn to prove this is not legit, who can help? How does this happen in the United States of America? Desperate for answers
A: You should comply with the protective action plan or the service recommendations of CPS. On your own, you should have a private alcohol evaluation and follow any recommendations of the evaluator. You should also take a parent education class to improve your parenting skills since every parent has room to improve their parenting skills. You must also have as much contact with your children as CPS will allow. You should also get letters of reference from adults who have observed you take care of your children.
