A: More information is needed to give a more definitive answer. Parents have a primary right to custody of their children. A judge has authority to award custody to a third person such as a grandparent but the judge must first find that neither parent is fit to have custody. The judge must have found the mother to have been unfit to have custody. The order may provide an explanation as to why the judge gave custody to the grandparent. If the order was issued less than 30 days ago, the mother has a right to appeal the order and may want to do so.
