Q: My girlfriend was charged with misdemeanor DWAI first offense. What type of penalties is she facing?

She has no other convictions or arrest record

A: A NYS DWI misdemeanor conviction will result in her having a lifetime criminal record. Sentence possibilities include combinations of the following: up to one (1) year county jail time and or a fine of $500 - $1000 dollars, 3 years probation, license revocation for six (6) months, NYS surcharges of up to $400 depending on where the conviction takes place, when her license is restored she will have to pay the DMV an additional $250 a year for three (3) years for the Driver Responsibility Assessment fee, mandatory attendance at a Victim Impact Panel Class, and a requirement that she install ignition interlock device in any motor vehicle owns for no less than 6 months. Needless to say she needs to contact an attorney for legal advise to explore her options and possible defenses.
