Q: involved in a traffic accident and i was given a failed to yield ticket.
also under court supervision for a cell phone violation . do i need a traffic lawyer.
A:
It wouldn't be a bad idea to at least schedule a consultation. When it comes to traffic accidents, the main concern is ensuring you do not face civil liability for the accident and minimizing this risk. For this reason, it is advantageous to have a traffic attorney assist you in resolving that case, particularly if there is any question as to whether someone was injured or the insurance company paying out.
Fortunately, the cell phone ticket supervision being violated won't create much concern. The only situation where a conviction for this offense would be problematic is in one of the following situations:
1). It was your second or subsequent violation
2). You received the ticket while in a construction, school, or emergency zone.
3). You were operating a commercial motor vehicle at the time
If none of these three apply, the cell phone ticket's supervision being violated won't pose any serious harm to your license as these are the only circumstances where it would be a moving violation and thus detriment your license.
All the same, it is beneficial to meet with a traffic attorney or at least call one for your accident ticket as it is possible in some instances to get those dismissed.
Hope that helps and if you have any questions, please feel free to contact me through the information found on my profile here.
Sincerely,
