Q: Can i get court supervision for 26 mph over the speed limit in Illinois?

I recently received a ticket for going 26 mph over the limit in woodford county. I know this is now considered a class b misdemeanor. My driving record is otherwise good. I'm trying to figure out if i need to consult an attorney given this new classification? Also wondering if court supervision will be an option?

A: Hello Asker,

First, I must emphatically state that court supervision is NOT legally possible for speeding offenses over 25 mph over the limit under 730 ILCS 5/5-6-1(q) if that is the offense you are sentenced to. That said, it isn't technically impossible to receive court supervision in practice. Often times, an attorney can arrange what is known as an amendment. If the attorney can negotiate this with the prosecutor, a speeding offense can be reduced from a misdemeanor level to a petty level. In the process, it places it below the threshold where court supervision is not barred by statute.

It would be VERY advisable that you contact an attorney about this because amendments can be much easier to receive when represented. Additionally, an attorney can offer other hidden savings. In getting court supervision, you prevent damage to your license, keep your insurance rates down, and improve your record. Additionally, with an attorney, your case can be called sooner enabling you to not miss as much work making it easier to afford legal fees. Finally, you have the peace of mind knowing that your case is being handled by a professional who can give you the best shot at court supervision possible.
