Q: Does 16 year old need to go to court for improper lane usage violation in Kane County to receive supervision.
My son received a ticket for improper lane usage in Kane County. They said he made a too wide of a left turn on a 2 lane road with a median in the middle. My son said he barely went over the line on shoulder. The ticket says do not appear and send in for supervision and traffic school. Do we send it in or appear in court. I thought to ask for supervision for a minor you have to appear. Let me know what we need to do. Not happy with this ticket at all. Thanks.

Hello Asker,
Technically, it is impossible for your son to receive court supervision by mail. Under 730 ILCS 5/5-6-1(n), the provisions of court supervision defined under subsection (c) are not available to persons under the age of 18 unless they appear in court and are given authorization to receive court supervision by a parent or guardian present in open court. For this reason, I am VERY doubtful the state's attorney's office will grant court supervision by mail. I would HIGHLY caution against mailing in this ticket. Doing so can easily lead to a conviction for an offense governing the movement of vehicles entering as a conviction. If this happens, your son WILL BE SUSPENDED if he receives another conviction for a moving violation within 24 months of this ticket.
