A: If you were stopped going 83 mph and required to go to court, you were likely traveling 26-34 mph over the limit if not more. This is a misdemeanor offense for which jail is a potential penalty. Additionally, it is not eligible for court supervision by statute. Because of this, a conviction is the only legally permissible result for this charge. This can result in a license suspension if you've had other tickets, higher insurance rates, and a criminal record. For these reasons, it is important that you speak to an attorney. If you attempt to go to court without bringing an attorney, the judge is very likely to tell you to return with an attorney due to the seriousness of this offense.

As for your reason, it is not an excuse to speed. Especially if the only thing the other driver did was insult you rather than something more serious like a hit and run accident. This argument is not only likely to fail but is also runs the risk of insulting the court and officer which can result in a harsher punishment than might otherwise be given. Regardless of what action you take, I would advise against volunteering this story in court.

Hope that helps and let me know if you have further questions!

Sincerely,

Jason A. Wilkins
