A: Hello Asker,

First, the degree of trouble you face depends on whether you received the ticket before or after your license was issued. If before, you risk losing it and being returned to permit status and having a license inaccessible for up to nine months. If it was after, this shouldn't occur but you still risk other penalties such as the one passenger limitation being extended longer than 6 months.

What I can say is that this offense alone cannot cause a suspension if you attend your court date SO LONG AS you have never been suspended before receiving the ticket. That said, this is an offense known as a class A misdemeanor punishable by up to a year in jail and a fine up to $2500. For this reason, the vast majority of traffic court judges will not allow you to resolve this case without being represented by an attorney. Failing to bring one on your first appearance will almost certainly end with you needing to reappear in court after waiting several hours. As such, it is recommended that you bring an attorney on your first appearance.

Lastly, due to the seriousness of this ticket, you can easily be convicted of this offense. If convicted, your license will be suspended for several months if you receive another conviction in the future. For this reason, you want to make sure this ticket is handled in a way that prevents future risk of suspension.

I hope that helps and please feel free to let me know if you have further questions.

Sincerely,

Jason A. Wilkins
