Q: I got a ticket for speeding in a work zone, can I get supervision? I have clean record.

Im 36 years old, on the thicket it says 57mph in a 525mph zone

speeding in a construction zone-workers present.

I have to go to Dupage Court, Will I have to pay a fine??

A: Hello Asker,

I am having a hard time determining what you ticket states. If you were in a 55mph zone, then yes, you are eligible for court supervision. It will entail a fine but supervision is by law allowed in your circumstance. This is a petty offense meaning no risk of jail comes with it but it does carry a high point value in the event that you receive a conviction.

If it was a 25 mph zone however, you will have been traveling 32 mph over the posted limit. This constitutes a Class B Misdemeanor punishable by up to 6 months in jail and a $1500 fine. It is also by the letter of the law not eligible for court supervision. Beyond the criminal penalties, these tickets being ineligible for supervision make them highly damaging to driving privileges as well as harmful to insurance rates and driving records available to employers. Because of all these factors, it is advised that you seek out a traffic attorney to minimize the harm to your license and potentially arrange of court supervision in spite of the charges you face. My recommendation is that you do bring an attorney to your first court appearance because as a matter of practice, judges in DuPage county are hesitant to enter judgment on these serious tickets in absence of a lawyer due to the broad harm they can cause.
