Q: 2nd DUI NJ, Saturday night I got in a accident.
I got in accident when sober, I was upset so i went home had a couple of drinks and came back. I got into my previously wrecked car and fell to sleep only to be awaken by cops knocking on my window three hours later. They tooke to the hospital, and the cop got a blood sample from my arm. He read me my Miranda rights in the hospital, I really think he didn't read them fully. I am scared to death of possible jail time if convicted. I really didnt think I had a drinking problem but I do. My parents went on vacation, and all of a sudden I got bored and wanted to drink when I was supposed to be studying. It sounds like you have a defense to at least the DWI if you can get a judge or jury to believe it, but based on your facts you probably also got a Leaving the Scene of An Accident Charge which compounds and makes your case much - much worse.
