Q: I got a speeding ticket going 40 in a 25, but there are no posted speed zone ahead signs. It goes straight from 55-25
I was obviously slowing down when I saw the first sign but he was already sitting there. I want to fight it, but not sure what I all need. I know there has to be posted speed zone ahead signs, and there aren't any anywhere on that road.
A:
Hello Asker,
I understand the frustration here and this may be a case worth fighting. I would ask that you look to default speed limits in the municipal ordinances of the city where you were stopped. It is not uncommon for some areas to have absolute speed limits that, in absence of posted signage, can set speed limits. My recommendation would be to look towards these just to cover all of your bases.
Hope that helps and let me know if you have further questions!
Sincerely,
Jason A. Wilkins
