New York, NY asked in Collections and Family Law for New York

Q: My son's father is $4,420 BEHIND in child support & now has off the books contracting jobs He has general liability...

He no longer is emplyeed through the employer that is on the court order, he now has general liability for his contracting bussiness, he makes great money with his new buss. But he's telling me he wants to go to support court to have it modified & to have the $80/week be lowered. He claims now, that because all of his contracting jobs now are not documented for that he can pick & choose what he presents to the judge as far as income.. I have his bank info as Well... He says that I will receive less then $80/week because of this. Note: he is still $4,420 BEHIND in support. I have some pictures of jobsite & work he has done. His rent is $1,600 nothing included 4 bedroom 3 bath 2 car garage home, but can't help out with CS I also have full custody of our son. Will his cs amount go down or up because of this?

A: You can file for a motion for contempt if he's not paying back-owed child support, and you can have the state take action against him for unpaid child support. The best first step is an Initial Consultation with an Attorney.
