Q: In Colorado, if I did not file a police report, how late can you do it for fender bender / minor accident?
,Man admitted fault to accident, we agreed to pay out of pocket or insurance, no police. He is now not answering my calls/texts. I have text messages with the man at fault admitting guilt/fault, asking for pictures of damage, setting up our time to meet for the estimate. I have the body shop as witness that he was at fault and was to pay all damages, I have the estimate we got together, I have messages of the estimate I sent. I also reported the accident to my insurance the day after it happened, just in case this happened, I however did not get a police report..... I see in hindsight I should have.... what are my options now?> file with is insurance myself? take him to small claims court?? should I file a police report now? any advice would be very helpful!
A: While you can file an accident report with the police, it will be of little weight. I would contact your insurance company and provide them with updated information and follow their instructions. You can also contact the other drivers insurance or file a petition in small claims court (both not recommended unless your insurance company will not assist you).
