Q: Can my former employer withhold my pay?
I quit my job on Monday, I'm experiencing symptoms of depression and anxiety, I am constantly put down and stressed out by my former boss, she is the owner and health provider of an independent clinic, I was overworked, under paid and under appreciated. I started experiencing memory loss, high stress levels, And I started coming home and just crying for hours on end. I quit trying to prevent a mental breakdown. My former boss just text me and said if I didn't show up to work tomorrow I would be adding insult to injury and that my resignation is not accepted. One of my former coworkers said that my former boss mentioned if I didn't show for work tomorrow I wouldn't be receiving my last paycheck. Is this legal? What should I do?
A: No, they cannot usually do that. See this article from a firm in your state discussing final paychecks: http://www.nmmlaw.com/lvlb/2013/06/11/pennsylvania-has-specific-law-for-final-paycheck-after-separation-from-employment/
