Q: I have completed a deferred felony sentence. CO state license application defines a conviction as "having plead guilty"
I was convicted for a felony sex offense in 2011, given a deferred sentence and completed it in 2016. Now I am applying for my Colorado Life Insurance license and it asks about previous convictions defined as "'Convicted' includes, but is not limited to, having been found guilty by verdict of a judge or jury, having entered a plea of guilty or nolo contendere or no contest, or having been given probation, a suspended sentence, or a fine."
Do I respond saying I have been convicted, or have I not been convicted because of the deferred sentence?
A: I recommend that you review your plea agreement. Does it require that you plead guilty as a condition of the plea?
