Q: Hey, i got my third speeding ticket this year and im only 18. two where 22mph over the limit and the third was 16 over.

two tickets were in different cities, and the first one was by ilinois state police. my initial plan was to go to court and ask for court supervision as well as traffic school, but i had court supervision on my second one. Many have said that your license may be suspended, but ive also heard from many people that they are racking up tickets and still have their licenses. i dont have the money to hire an attorney for this so i was wondering on what action i can take doing this alone.

A: Hello Asker,

Technically, you are at a high risk of suspension. The rule for suspension is as follows: A driver under the age of 21 will be suspended if 1). he/she receives two moving violations that are 2). both issued prior to turning 21 and are 3). issued within 24 months of one another that 4). both result in a conviction.

For the purposes of this rule, court supervision does not count as a conviction but it can if you violate the terms of supervision by failing to pay fines, getting tickets during the supervision period, or failing to compete traffic school.

As for supervision, the code is clear at 730 ILCS 5/5-6-1(k) in that court supervision for moving violations is only available if in the 12 months preceding the issue date of the ticket you have not been assigned court supervision more 2 times. In practice, most prosecutors interpret this to mean court supervision can only be granted twice every 12 months.

My recommendation would be to at least speak to an attorney in a free consultation. There is nothing to lose except your license. Also, representation fees for traffic matters are more reasonable than you might imagine. Before you discount even scheduling a free consultation and running into court blindly, you should seriously speak to a lawyer first.
