Stanhope, NJ asked in Criminal Law and Libel & Slander for New Jersey

Q: Hi, can I sue someone for my lawyer fees if they sued me without having any evidence against me?

I have been accused of harassment, trespassing and criminal mischief. The other party claimed that they had security camera evidence against me yet never produced it. I wanted to represent myself but the court said I needed a lawyer because it was a criminal case. Would I be able to sue them for my lawyer fees?

A: More information is needed to answer your question, but the general rule is no, you may not sue them for your lawyer fees back. I would concentrate on winning your criminal case first and then worry about getting your money back, you have some very serious charges against you and I suggest you hire the best lawyer your can find as a conviction could lead to jail, especially if you have any prior criminal record.
