Q: What constitutes unlawful death?
Our 23 yr old son (with misdemeanors) lived with us a few months last year without being on the lease as an occupant. When the management found out that he had been living with us and that he had prior convictions that told him that he must leave the property immediately. Two to three hours later our son died on a heart attack approximately six miles away.
A: I don't see a case there. He was asked to leave--which didn't mean that second. He dies thereafter. There has to be a legal duty by one person to another, that is not met or is breached, and that breach causes the death. The landlord owed no duty to your son that was violated that I see.
