Montevideo, MN asked in Family Law and Child Custody for Minnesota

Q: I'm trying to use the family court to remove an OFP and get parent time. Any help with what documents I need?

My ex put a restraining order on me against my children. One night they told her I had disciplined them at the library for being brats and she freaked out and ran to the court house. She is well versed in using fear to fool people into thinking she is a victume. It has got her a lot of attention and support and now she's using the kids to try to hurt me. So I need to know if the family court will provide a way for me to set up visitation. The judge sided with my ex saying the kids had fear of me for excessive discipline. (even though the kids never cried leaving the library and were just fine when they left my place going to hers) I have the kids going to family therapy with me now as part of a modification to the OFP. Any help getting the documents for a family case to get custody back would be appreciated. We have a divorce decree with about 50 50 custody arranged. I'm just trying to navigate back to our original arrangement.

A: Any advice given on this website would not adequately address your needs. An attorney needs to know more about your case and see the various orders to make a determination. You will need to hire an attorney to determine if there is anything that can be done. Expect paying a nominal fee for the review and additional fees in the event you can bring a motion in this matter. If you cannot afford an attorney, contact your local legal services organization.
